I need to know how to do a will and how to go about giving a person power to speak for me should I become unable to speak for myself.

Creating a Will - A properly drafted and executed Will gives the Probate Court guidance to determine who will receive your property (assets) when you pass. There is no requirement to have a lawyer draw up the Will, but it is advisable to have a knowledgeable lawyer do so. By State law only a lawyer is allowed to assist in the preparation of a Will. There is also a State of Michigan statutory Will form available on the internet at http://www.michigan.gov/documents/statwill_11444_7.pdf. However, this form is not designed to meet everyone's needs.
Giving someone power to speak for you - For this purpose there are two types of legal documents known as powers of attorney. To give someone power over your money to have them help pay the bills you should consider a Durable Power of Attorney for Finances. For medical and care decisions, you should consider a Durable Medical Power of Attorney (or Patient Advocate Designation). Various forms of both of the documents can be found on the internet. Some are better than others and some may not even be effective when needed. Like the statutory Will, it is recommended that you seek the advice and guidance of a qualified expert attorney to make sure you understand your options and that the legal documents you sign will work when needed and that your wishes will be carry out.
